Eviction action

Eviction proceedings are understood to mean "the forced eviction of tenants from the buildings they occupy and actions tending to that end".

This electronic procedure, takes place exclusively at the Balcão Nacional do Arrendamento (BNA), an entity under the Direção-Geral da Administração da Justiça (DGAJ) which covers the entire national territory.

It consists of a judicial action aimed at terminating the lease agreement in those cases in which the law requires the use of a judicial procedure, thus following the form of a common declaratory process.

Since it is an action of a declarative nature, the eviction action results in a ruling which decrees the termination of the lease and, consequently, the requirement to vacate the property and deliver it to the respective landlord within 1 month after the termination of the lease.

Its acceptance depends, among other conditions, on the existence of a written lease agreement and proof that the respective stamp duty has been paid.
