The Nacional Letting Centre

The National Letting Centre (BNA) is an agency of the Directorate-General for the Administration of Justice (DGAJ) which covers the whole national territory, has exclusive competence for the processing of the special eviction procedure in the whole national territory.

The Special Eviction Procedure is a procedural means which is intended to make effective the termination of the lease agreement when the tenant does not vacate the leased premises on the date set by law or by the date set by the parties.

To which cases is the special eviction procedure applicable?

It is applicable in cases of termination of the agreement by agreement (revocation), due to opposition to the renewal by either the landlord or the tenant, due to expiry of the term set in the agreement, due to termination of the agreement by the landlord or by the tenant, due to termination based on the payment of rents and due to termination based on the tenant's opposition to the carrying out of works.

What are the conditions for the acceptance of the special eviction procedure?

Its acceptance depends, besides other conditions, of the existence of a written lease agreement and proof of payment of the respective stamp tax.

Is the constitution of a lawyer compulsory?

Within the scope of the special eviction procedure the representation of a lawyer is only compulsory for the presentation of the opposition to the eviction petition and in the acts following its distribution to the court.
